Mediation Regulation      As many of you may know, this year I served on the South Carolina Workers’ Compensation Commission’s task committee, which drafted proposed regulations requiring mediations in certain South Carolina Workers’ Compensation claims.  The regulation has been submitted to the General Assembly for approval, and we anticipate that the regulation will be approved in January of 2013.  Stay tuned as we receive updated news on approval status.      The proposed regulation, which you can read here, would make mediation mandatory in certain classes of cases, including any case where a claimant is alleging permanent and total disability.  My practice as a mediator has increased dramatically in the past few months as many commissioners have been ordering mediations; I have mediated 25 cases since the SC Workers’ Compensation Educational Association’s seminar in October.  Please feel free to contact me with any questions about this new regulation or your mediation needs.
